Neither the H-1B nor the H-2B cap has been reached!
As of September 25, 2009, opportunity to file still exists
for the fiscal year 2010 program.
In addition, although 20,000
cap-exempt petitions for beneficiaries with advance degrees
have been received, petitions are still being accepted in
realization that not all of those submitted will be
approved.
Only 46,700 H-1B cap-subject petitions
have been filed toward the 65,000 Congressionally-mandated
cap. USICS will continue to accept both cap-subject
petitions and advanced degree petitions until enough have
been received taking into account the fact that some of
these petitions may be denied, revoked, or withdrawn.
