 Neither the H-1B  nor the H-2B cap has been reached! 

As of September 25, 2009, opportunity to file still exists for the fiscal year 2010 program.

 

In addition, although 20,000 cap-exempt petitions for beneficiaries with advance degrees have been received, petitions are still being accepted in realization that not all of those submitted will be approved.

Only 46,700 H-1B cap-subject petitions have been filed toward the 65,000 Congressionally-mandated cap.  USICS will continue to accept both cap-subject petitions and advanced degree petitions until enough have been received taking into account the fact that some of these petitions may be denied, revoked, or withdrawn. 

 

            

 


K-1 Fiancé / Fiancée Nonimmigrant Visas 

Kennedy Law Firm serves U.S. Citizens and their fiancés and fiancées in obtaining K-1 visas to enter the United States in order to be married inside the United States.

  • The length of time it takes us to obtain a fiancé(e) visa depends on the state in which you reside, the country in which your fiancé(e) lives and the immigration processing center where the application is processed. 
  • The fiancé and fiancée must each demonstrate ability to marry and intent to do so within 90 days of the alien’s U.S. entry.

  • The fiancé and fiancée must prove that they have met within the previous two years.

This visa is a temporary nonimmigrant visa granted for a specific purpose.

  • Within 90 days of entry, the fiancé or fiancée must marry the petitioner inside the United States.

  • The fiancé (or fiancée) is obligated to either marry the petitioner or go home. 

  • If the fiancé (or fiancée) does not marry the Petition, he or she will neither be able to adjust status to legal permanent residency nor change status to any other visa classification.

In the case of a K-1 fiancé visa, a nonimmigrant (temporary) visa is issued even though the fiancé has immigrant intent.

  • The K visa suspends the usual rule pertaining to nonimmigrants denying visas to those who express or are considered to possess immigrant intent.

Children of the K-1 spouse can enter with a K-2 visa.
