As of September 25, 2009, opportunity to file still exists for the fiscal year 2010 program.

 

In addition, although 20,000 cap-exempt petitions for beneficiaries with advance degrees have been received, petitions are still being accepted in realization that not all of those submitted will be approved.

Only 46,700 H-1B cap-subject petitions have been filed toward the 65,000 Congressionally-mandated cap.  USICS will continue to accept both cap-subject petitions and advanced degree petitions until enough have been received taking into account the fact that some of these petitions may be denied, revoked, or withdrawn. 

 

            

 


K-3 Spousal Visas

The K-3 visa process offers the quickest manner possible for a spouse of a U.S. Citizen to obtain entry into the United States  and reunite with his or her family.

The K-3 process  allows spouses of U.S. citizens to enter the country as quickly as would fiancés and fiancées of U.S. citizens.  Congress created the K-3 process after it became very apparent to Congress that K-1 fiancé visas were being processed much quicker immigrant visas for spouses.  Basically, Congress adapted the K-1 process to the benefit of spouses.

Indeed the K-3 process incorporates and takes advantage of the K-1 visa process. It is a hybrid process requiring dual petitions that .

Unlike a spouse who  undergoes consular processing for an immigrant visa, which results in a grant of  legal permanent residency status upon entry into the United States, the K-3 spouse enters as a nonimmigrant .  As a nonimmigrant, the K-3 spouse must, once inside the United States, apply to adjust status to legal permanent residency.

While consular processing for an immigrant visa is an available option, the advantage of the K-3 is that it allows the a spouse of a U.S. Citizen a much quicker entry as compared to traditional consular processing. The slower option of consular processing requires the usual filing of a marital petition followed by the usual year plus wait before legal permanent residency can be approved.

Children of the K-3 spouse can enter with a K-4 visa .

The I-94 provides the expiration of the visa.  The status is valid for 2 years each entry and remains valid as long as the original spousal petition is pending.
